Workplace Injury Rehabilitation and Compensation Act and regulations
The WIRC Act addresses what happens when a Victorian worker is injured.
The WIRC Amendment Bill 2025 was introduced to Parliament on 4 March 2025.
The majority of the changes will take effect following the Bill's passage through Parliament, with the changes related to the increase to the child pension and the obligations relating to return to work coordinators taking effect on a day to be proclaimed.
The WIRC Act 2013 applies until this time.
Workplace Injury Rehabilitation and Compensation Act 2013
The Workplace Injury Rehabilitation and Compensation Act 2013 (WIRC Act) addresses what happens when a Victorian worker is injured or killed. It covers:
- insurance
- workers compensation
- claims
- rehabilitation
- return to work
- dispute resolution.
The WIRC Act came into effect on 1 July 2014. It replaced 2 previous acts:
- Accident Compensation Act 1985
- Accident Compensation (WorkCover Insurance) Act 1993
Which law applies to workers' compensation claims?
Claims made since the WIRC Act came into force are dealt with under the WIRC Act. If you made a claim before 1 July 2014, it is still dealt with under the Accident Compensation Act 1985.
Workplace Injury Rehabilitation and Compensation Regulations 2024
The Workplace Injury Rehabilitation and Compensation Regulations 2024 are made under the WIRC Act. They set out additional details about matters like compensation and insurance.
