Man killed by firework explosion

WorkSafe is reminding the public that only qualified, licenced pyrotechnicians are allowed to use or possess fireworks in Victoria.

Background

A 19-year man has died following a firework explosion at a residential development site in Kalkallo. It is believed he was discharging commercial grade fireworks.

It is a criminal offence to discharge a firework within Victoria, unless you are a qualified and licensed pyrotechnician. It is also a criminal offence to possess fireworks unless you are a licenced pyrotechnician. If you are found in possession of fireworks without a licence, they may be seized by a WorkSafe inspector or a police officer, and you could be prosecuted.

Safety issues

Fireworks contain an explosive charge and burn at high temperatures. Incorrect use can cause serious harm to people and property. This includes fires, burns, eye injuries and death.

Fireworks are not designed to be used by members of the public. They should only be discharged by a qualified person who must:

  • hold a license to use fireworks, or
  • be supervised by a person who holds a licence

To control the risks associated with the use of fireworks, make sure they are only discharged by a qualified and licensed pyrotechnician.

Legal duties

A person must not use or possess fireworks unless they hold a licence to use fireworks as a pyrotechnician.

A licenced pyrotechnician must, so far as is reasonably practicable, prevent people without a licence accessing fireworks.

Penalties

Unlicensed possession of fireworks may constitute an offence under section 45 of the Dangerous Goods Act 1985 and Regulation 142 of the Dangerous Goods (Explosives) Regulations 2022.

People who use or possess fireworks without a pyrotechnician licence may face significant fines and in some cases imprisonment.
