Charges after truck driver fatally crushed

WorkSafe has charged a road safety equipment manufacturer and supplier following the death of a delivery truck driver at its Nar Nar Goon depot in November 2021.

Saferoads Pty Ltd, trading as Road Safety Rentals, is facing two charges under section 26(1) of the Occupational Health and Safety Act for failing to ensure, so far as was reasonably practicable, that a workplace under its management and control was safe and without risks to health.

The company is also facing four charges under section 23(1) of the OHS Act for failing to ensure, so far as was reasonably practicable, that people other than employees were not exposed to health and safety risks, including the risk of being crushed by falling objects and of powered mobile plant colliding with pedestrians.

The 34-year-old died when a metal barrier weighing about 925 kilograms toppled onto him from his semi-trailer as barriers were being unloaded using a forklift.

The matter is listed for a filing hearing at Melbourne Magistrates' Court on 22 February 2023.
